So What Do You Think of Pinterest Now?

I love Pinterest and have been pinning away. I have over 100 boards and over 1400 followers. I pin images from many different types of things I am interested in from recipes to vintage collectibles.

To be honest I did not read their TOU too closely when I signed up. You should always read a sites terms of use (TOU) when you join!


Up until about a year ago I was very involved in the Mixed Media art world. I was a designer for an image sheet website for about 3 years, a writer on their website creating tutorials using their products. My art had been published in a few magazines and a book. When I joined sites I paid much closer to the TOS. People stealing images of your art work is very common. People taking an image of your art work and photoshopping it into something else and profiting from it is very common.

Now I am a food blogger. Recipes can not be copy righted. I got a little lax in paying attention the TOU of sites that I joined. I quickly scan them to make sure they do not own my content if I publish it to their site.


 How I missed the big warning sign on Pinterest I don’t know.

For two weeks now I have been reading all the outcries over the copy right issues on Pinterest. 


Well I make sure when I pin something the original site is given credit. And if you are thinking the way I was…… that it covered you as long as you gave credit then you better think again.



I read something last night that shocked me. It actually made my stomach drop. Here is what I read…….


Ownership
The Site, Application, Services and Site Content are protected by copyright, trademark, and other laws of the United States and foreign countries. Except as expressly provided in these Terms, Cold Brew Labs and its licensors exclusively own all right, title and interest in and to the Site, Application, Services and Site Content, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site, Application, Services or Site Content.
That highlighted sentence means that any content you pin to the site gives away your ownership.  More on that in a minute.

Member Content
We may, in our sole discretion, permit Members to post, upload, publish, submit or transmit Member Content. By making available any Member Content through the Site, Application or Services, you hereby grant to Cold Brew Labs a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content only on, through or by means of the Site, Application or Services. Cold Brew Labs does not claim any ownership rights in any such Member Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such Member Content.
>This highlighted sentence means that once you pin something on the site Pinterest now has the right to use your images any way they like. They can take an image and use it the way it is or change it and use it.  

They also can profit from that use and there is nothing you can do. Here is an example: They could take your image and print up t-shirts, sell 5 million of them and you won’t see a dime of the money and you have agreed to that. There is nothing you can do about it. By using the site you have agreed to the terms of their service.

This is why so many photographers and artists are up in arms about Pinterest.

  Notice in the next un-highlighted sentence they say that they are not claiming any rights to your content and that they will not restrict you from any rights to your own content.

That’s a bit confusing isn’t it? Sounds like they may have canceled out the highlighted term before that one. To me what I think it means is that they have the right to use your content that you have uploaded to the sight but they will still allow you to use your own content however you see fit outside of Pinterest. 

Now you may be thinking well fine that doesn’t affect me because all I do is pin things I find on other blogs or websites. If I see a cool craft idea I just pin it and this little clause in the terms of service doesn’t affect me in the least. I make sure that my pin links back to the original content. So I am good to go.

You acknowledge and agree that you are solely responsible for all Member Content that you make available through the Site, Application and Services. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all Member Content that you make available through the Site, Application and Services or you have all rights, licenses, consents and releases that are necessary to grant to Cold Brew Labs the rights in such Member Content, as contemplated under these Terms; and (ii) neither the Member Content nor your posting, uploading, publication, submission or transmittal of the Member Content or Cold Brew Labs’ use of the Member Content (or any portion thereof) on, through or by means of the Site, Application and the Services will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.


This means that you must be the owner of the content you pin on Pinterest and if you are not Pinterest is not responsible. 

You agreed to the TOS by using the site. 

That means that you agree that any content you pin you have the rights to do whatever you want to with it. That you are the owner. But if your pinning from someones blog you are not the owner are you?

Pinterest is covered and can not be held responsible (in vio
lation of copy right laws) if
you pin something you don’t have to rights to by adding this into their TOS.



So what am I going to do? I have two boards that I have pinned my own blog content to. I think I am going to delete those boards. 


Now if you have pinned my content based on the TOS I can contact Pinterest and they will remove it because you don’t hold any rights to my content. 


But because I pinned my own contents and I do have the copy right to those images I have given away my rights to that content and it is all legal and binding based on Pinterest terms of service.

It’s Time For A Change and Lemon Curd Tarts

For a long time I have been coveting mini tart pans.  I would catch myself thinking….I could make _______. Fill in the blank.

If I only had some mini tart pans!

A couple of weeks ago I finally picked some up at World Market. I love World Market! I could walk around that store for hours and never see everything.

I’ve have been having so much fun coming up with recipes this past month using the Orange Curd I made. I decided to use the same recipe and make some lemon curd.

Although the recipe turned out as good as the orange curd  I didn’t like the flavor of the lemon curd as much as I did the orange curd. I think I’ll stick with the orange curd.


 You may see another recipe show up using the lemon curd though. I still have about a pint left to use up.


When I was thinking about making the lemon curd tarts I wanted to use a Lintzer torte crust but didn’t have enough almonds on hand. The days I have to bake and photograph for my blog are limited so instead of running to the store  for more almonds I went to the internet. 


I looked at many different tart crust recipes before settling on one that was shortbread like. That was the flavor I wanted for the crusts. The problem with that recipes is that it is too soft to roll out. I had to literally smear the dough into the tart pan. While I was making them I thought to myself never again. That said I am not going to share the recipe today. The flavor of the crust was shortbread like. I loved the flavor but it is really too much trouble. I’ll try to make some adjustments to the recipe and if it turns out well I will share it.


 Some of tart shells are filled with lemon curd. I then made a very thick lemon curd whipped topping using the this method and filled a few of the tart shells. The whipped topping was also used on some of the tarts that were filled with the lemon curd. Then a raspberries was added as garnish.


They tasted really good but like I mentioned earlier I prefer the orange curd to the lemon curd so next time that is what I will be using for a filling.



Time for a Change


For close to two years now I have been thinking about moving my blog over to WordPress. But Blogger has been good to me and I know this platform backwards and forwards. The thought of having to learn a new blog platform has kept me from making the move. 


At the end of last year I decided that if I wanted to take my blog to the next level a change was needed.


I went back and forth trying to decide if I should attempt the move myself or hire someone to do it for me. I went as far as contacting someone and inquiring on the cost and what was involved. Eventually I decided that I would take the plunge and try to make the move myself. I bought an ebook and  
decided that I might just be able to do it myself.


So far so good. I have set up a hosting account, set up a mirror site and installed WordPress. I am leaning toward buying  Genesis and a  Child Theme so I don’t have to worry about designing my new blog from scratch.


The scariest part is yet to come when I move my blog files from blogger to WordPress. Hopefully everything will go smoothly. If not you may be able to hear my scream where ever you might be. Wish me luck.


I am taking it slowly but I hope to make the complete move in the next couple of weeks.

No Bake Orange Curd Creme Pie Recipe

Every once in awhile I create a recipe that totally blows my taste buds away. 

This is one of those recipes.

I know a recipe is a hit when my family members comment on how good something was not long after it is all gone.  There is no better compliment than that. 

So I will be making this pie again this weekend for a little family get together.

If your a regular blog reader you know that I have been obsessed with creme fraiche. The last couple of recipes have either included creme fraiche or orange curd or both. 

I hope your enjoying them as much as I am because I believe there are a couple of more heading your way.

 Actually I made some lemon curd so the next recipe will be using it as an ingredient.

I am amazed at how wonderful the flavors of the curd and creme fraiche come together. The tart orange, the tangy creme fraiche and just a hint of sweet from powdered are wonderful together.

 Now add a little cream cheese and what do you have? 

A light and airy almost cheese cake like pie. From the title you can see that I did not call it a cheese cake. 

I could have called it something like a no bake Orange Curd Creme Cheese Pie. 

Although it closely resembles a no bake cheese cake. There is no baking involved with this recipe. A perfect dessert for those summer days when you just don’t want to heat the house up by using the oven.
 The big difference between this pie filling and a cheesecake filling is that this pie is light and airy. Not thick and dense like a cheese cake should be.

Below is the recipe. Let me know if you try it and how you liked it.

Orange Curd Creme Fraiche No Bake Pie

Orange Curd Crème Pie

Makes 1 pie, serves 8
1 Keebler Shortbread Ready Crust or a graham cracker crust

8  ounces, softened cream cheese

1 cup, sifted powder sugar

1 ½ cups homemade crème fracihe

¾ cup orange curd

½ teaspoon homemade vanilla extract

zest from one orange
Using a stand mixer beat the softened cream cheese until smooth and creamy.

Add sifted powdered sugar to the bowl and beat on low until smooth.

Add crème fraiche, orange curd, and vanilla to bowl. Mix on medium until incorporated completely.

Turn mixer on high and beat until light and fluffy, about 3 minutes.

Remove bowl from mixer base if using a stand mixer and fold in orange zest.

Spread into the pie crust and smooth top.

Refrigerate at least 3 hours or overnight. Over night is really best.
Serve with a spoon of crema fraiche whipped topping or whipped cream.
If you still have some crème fraiche left, to one cup of crème fraiche add a tablespoon of sugar and beat on high with a hand mixer until stiff peaks form. 

Add a spoon full of this whipped topping to each serving of pie.
